Inquest of Lunacy
On this 30th day of April A.D. 1861, a written complaint and affidavit having been filed in accordance with the statute in such case made and provided. An Inquest was on the 1st day of May A.D. 1861 by the undersigned Probate Judge held in due form of law in regard to Samuel Irwin, a resident of Richland Township, Vinton County, Ohio, who was [?] found to be insane, to be an inhabitant of the State of Ohio, having a legal settlement in the township of Richland of Vinton County, that his Insanity is of less these two years duration, and that he is entitled to admission into the Ohio Lunatic Asylum, to undergo treatment therein, and it appearing to the undersigned Probate Judge that the said Samuel Irwin being permitted to go at large would be attended with danger to community, an order was issued for his confinement in the said of the County of Vinton.
Joseph Kaler, Probate Judge
I have taken the body of the within named Samuel Irwin and now have him before the within named Judge. I have held the said Samuel Erwin in custody by the Orders of the Probate Judge of Vinton County the said Samuel Irwin having been found to be insane and dangerous to be at large.
Fees-200 (?) Sig. Sheriff
To the Honorable the Probate Judge within and for the County of Vinton and State of Ohio.
Your Petitioner Samuel Ervin of said County represents to your Honor that he is unlawfully detained by [?] Francis [Shades?] Sheriff of said County of Vinton and by him incarcerated in the jail of said County by the Order as he is informed and believes of Joseph Kayler, Probate Judge within and for said County, Upon the finding by said Judge that your petitioner was insane and that his living at large would be attended with danger to the safety of the community.
Your petitioner represents that he is fully restored to reason and he prays that a Writ of Habeas Corpus may issue upon his application in that he may be released from said imprisonment. May 29, 1861.
The undersigned having been summoned by Joseph Kayler, Probate Judge of County of Vinton, in State of Ohio, (?) upon a proceeding upon a habeas corpus (?) out by Samuel Irwin, who was confined in the jail of said County, as a dangerous Lunatic hereby certify that I have recently examined the said S. Irwin as the attending physician and am of the opinion that he is at least partially restored to reason and sufficiently rational to transact ordinary business and that, in my opinion his being permitted to go at large would not be attended with danger to himself or others. (Signed) A. Wolf, M.D.
Released by Judge Kayler

"The electors for Governor of Ohio, 1805, in Salisbury township, were the following:
John Hilverson, James E. Phelps, John Niswonger, Elam
Higley, William Sparks, Brewster Higley, Daniel Strong,
Caleb Gardner, Cornelius Thomas, John Miles, William Green,
Nimrod Hysell, Stephen Strong, Jared Strong, William Barker,
Daniel Rathburn, Samuel Denny, Hamilton Kerr, Thomas
Shephard, Benjamin Williams, Horatio Strong, Joel Higley,
1st, James Smith, William Spencer, Joel Higley, Jr., Abel
Larkin, Samuel Ervin, Felix Benedict."
"Samuel Ervin built a cabin near the site of what is known as the "Horton boatyard" in 1807, being the first settler of the town of Pomeroy. Amos Partlow came in 1809 and built his cabin about where the Excelsior Salt Works are situated, and that was the second house. The third cabin was erected by Frank Hughes on the ground where the court house stands, and John Mason put a cabin on Sugar run, being the fourth dwelling house in Pomeroy. Mr. Ervin vacated his house in favor of John Bailey and built another cabin at the mouth of Kerr's run; lived there in 1815, when he sold to Nathan Clark, who was therefore about the fifth settler of the town of Pomeroy.
Some of the above mentioned improvements were sold to other parties. Clark sold his improvement to Robert Bailey or Randall Stivers, who afterwards sold to Major Dill. Nial Nye bought a lot of Dill and built the first store house, where he kept the first post office in Pomeroy in 1827. Mr. John Knight bought the improvement made by Mr. Ervin of a Mr. Miles, and Samuel Grant bought the Partlow improvement.
Robert Bailey, Elihu Higley, John Bailey, David Bailey, Hedgeman Hysell, Leonard Hysell and Elam Higley met at the house of Samuel Ervin and from there started to Gallipolis and volunteered under General Tupper to serve in the War of 1812.
Thomas Ervin, Robert Bailey, David Bailey and John Bailey were pioneer keelboat men, who boated salt from Kanawha to Pittsburg, the boat being owned by P. Green and Jack Allen.
The first public road cut through the woods from Gallipolis to Chester was opened by Samuel Ervin, Asahel Cooley and Hamilton Kerr. [Note: The date of this road is not given, but there were settlements on Leading creek and at Athens as early as at Chester, and may have been opened as early by way of these settlements from Gallipolis to Athens.] It should be borne in mind that many roads were barely marked out for horse or foot men that were never opened for teams. Mr. Thomas Matthews settled in Chester in 1798 or 1799, and he told me (Larkin) while we were in company passing over the hill on the Rutland road to Middleport that there was where he and Hamilton Kerr and some other men whose names are forgotten located a road to Shade river, crossing Leading creek where the K. & M. Railroad crosses that stream, running immediately up the point of that hill and following the ridge all the way west of Middleport and Pomeroy, but that road was never opened for teams. S.C.L.
Mr. Ervin stated that in 1814 the Ohio river was very high, so that his father, Samuel Ervin and family, were compelled to leave the cabin and take shelter in a cave, where they lived seven days and nights, in much discomfort, as it was in the month of February."

I am enclosing in this letter a copy of part of the family record in an old Bible of Mother's which I got at the time of her death. Part of this leaf had been torn off and lost but from this you will be to judge for yourself whether the Wm. Pewtherer here mentioned was your father. The Agnes Pewtherer whose birth is given May, 1814 was my mother's oldest sister, and her full name was Nancy Agnes. There were four girls and three boys--Aunt Malinda and a twin sister Matilda--then the youngest boy in the family was John. Aunt Nancy married a man named Sharp, and she had five sons and one daughter. Aunt Matilda's married name was Johnson, and "Granny" Kuykendall was my mother's grandmother. My mother's people on her mother's side were Holland Dutch and came from Penn, but Grandpa Pewtherer came from Scotland. They came to Ohio before my mother was born. Uncle Abraham Pewthers lived in Iowa. Mother was 68 when she died in 1892. not signed, looks like copy of Mrs. Abry letter.
_______________
To Mrs. Abry 9-7-17
Mentions writer is a sister of Mrs. Vincent. Beginning with the Pewtherer side of the family, my great grandfather of this name came from the highlands of Scotland some time in the 18th century, the precise year, I never heard my father say, but in time to serve as a soldier in the Revolutionary War.
My grandfather, John Pewtherer, was born in Scotland, and as a child came with his father to America at the age of nine years, grew up to manhood and was twice married, the last time to the Widow Price, who was my father's mother. My grandfather Pewhterer was in the war of 1812-1814, also in one of the Indian wars. My father, William Calender Pewtherer, was born in Beaver County Penn., May 28, 1819. I have an indistinct recollection of my father speaking of a brother named Abraham. One of his brothers, Joh, I think was his name, was a soldier in the Mexican War. After the war in 1850 he started overland to Calif. but died on the plains of Cholera. My father died 9 years ago.
Grandma's father, great grandfather Kuykendall, settled in Penn, in an early day--was a man of comfortable property--a flour miller by trade--owned nearly all of the townsite of Old Brighton including a flour mill of nine run of stone, endorsed a note of Ross and Maloy who shirked payment, saw it would take everything, and moved into the wilds of Ohio, gave up everything, and died of cancer near Chilicothe, Ohio.
Incidentally the creditors later found sufficient property to satisfy the claims of Ross and Maloy, leaving the town and mill property to the claims of the lawful heirs of the decedent owner. Later this same Ross and Maloy, so my father was informed, took possession of the flour mill and operated it in their own interest for years, finally had a falling out and went to court, my father informed by a member of the jury. He said that search legal records showed the ownership still vested in the Kuykendalls. My father conferred with part or nearly all of the heirs with a view to take legal steps to secure the property, but they decined to take hold. I have no doubt, Mrs. Abry, but that your mother and my father are sister and brother. "Oh how often have heard my father speak of his sained mother, the best of mothers with him;. Signed George W. Pewtherer, Neskowin, Oregon.
_______________
Letter (from Nancy Ophelia) to Mr. G. W. Pewtherer 12-31-17 Neskowin, Oregon, not signed: Summary by the person typing the excerpt says that the letter "says that they are first cousins and their Grandfather Pewtherer came to America and was a soldier in the Revolutionary War.
"The brother of your father and my mother, who started overland to California and died on the way was James and not John. He was only a half brother, being a son of Grandpa Pewtherer by his first wife. Grandma Price Pewtherer also had one son, Jacob Price.
My mother had some of Uncle James Pewtherer's books, and at the time of my father's death, they went to my oldest brother and wer later destroyed by fire.
I believe now that I have heard the matter of that Mill property in PEnnsylvania mentioned when I was a child, but I hgot the impression it was property in Scotland--In never knew any of the particulars because my fhater never talked business matters before his children.
Ther are two or three cousins much older thatn I who could tell you more about the family than I--one A. L. Johnson, son of Aunt Matilda, one of the twin sisters. He lives in Kansas. The other two are Hiram Sharp, son of Aunt Matilda, the other twin sister, and James Ervin, son of Aunt Nancy Agnes. He was in Illinois.
_____________
1-17-1918 Long letter--only part here.
I regret that I failed to follow my family history, etc.--confess to having little patriotic ancestral pride, as great grandfather Pewtherer as a soldier, helped to gain our liberties and establish the nation as such--as a soldier in the second British war, and assisted in maintaining our national integrity. As to his being a soldier in the Revolutionary War, I think there is no probable doubt, as I have heard my father speak of it a number of times in the years passing.
Great grandfather had two sons, both married, but one of them had no children and the ancestral line descended through grandfather. Both grandparents were married before marrying each other. Each had two children, whether all were sons I could not say. The son that died on the plains never married.
Grandma's son, James Price, as I recollect, went to California, engaged in the mercantile business, prospered, came to a time when he thought it best to sell out-- realized $40,000 and planned to move to another place--but that was the last any of the family could learn. Since, Father addressed two or more letters to him in Calif. but received no answer.
Father grew to Manhood in Ohio, went to Indiana, then to Illinois, then to Texas, next to Missouri, in 1856 to Minnesota, where we stayed eleven or twelve years--then bought 2 or 3 thousand acres of land in the Western part of old Virginia in the coal and iron belt and moved there in 1867. Remained there five years, Country improverished and town (torn?)up as result of Civil War, family dissatisfied all of the time. Sold at a sacrifice to a company reputed to be worth a million dollars, gave time on part, the panic of 1873 settled on country--company was over sixteen years in backruptcy and father received next to nothing. He never seemed to gain in finances afterward. A year and 9 months in Nebraska, found fine soil and bountiful crops 1872, later saw what drought and grasshoppers could do--moved west and landed in Portland 44 years ago. Signed G. W. Pewtherer.

He died in Ross Co., in Franklin Twp. That is where his daughter Miranda Oiler lived. He died in 1876. I have heard from another researcher that Samuel and Jane were his parents, but I have no proof. I did have some other info. pertaining to some of his children, but not all of them. I am descended from Miranda Ervin Oiler and Frederick Oiler. He is buried in Gallia Co., at Ewington Cemetery on a farm. It is not the big Ewington one. I have been there. I would love info. pertaining to your line as well. I went to the website you mentioned and put in for membership.....hopefully we can all gather a little more info. Talk to you soon. Lisa

DIED ON BIRTHDAY
I.N. Tucker passed away suddenly while son was enroute to visit him.
While his son and wife were speeding here to help celebrate his birthday, Isaac Newton Tucker, one of the best known men of the vicinity, passed away Saturday morning at 2 o'clock, that day marking the completion of 64 years of life.
Mister Tucker had been a sufferer from attacks of heart trouble for some time but was in good spirits and good health. His brother, W. E. Tucker, had spent the evening with him, and before going to bed Mr Tucker had studied his Sunday School lesson, leaving the Bible lying open at the lesson when he retired. About 2 o'clock, his wife was awakened by his struggles and he passed away almost immediatley.
Surviving him are his wife, two sons and tree daughters; Sam and Harmon of Van Lear, KY, the latter of whom was enroute here, bringing a birthday remembrance, when his father died; Mrs Robert Hutchinson of Huntington, WV, Mrs Bruce Barnett of Camba, and Mrs Sam Ely of this city. He also leaves two brothers and three sisters; W E Tucker and Mrs Marion Downard of Wellston, and Lot Tucker, J R Tucker, and Mrs Melissa Perkins living east of this city.
He was a man of fine principles and many friends are saddened by his sudden death.
The Funeral was held at the Latter Day Saints Church Tuesday afternoon and interment was in Salem cemetery. Those here for the funeral were: Mr and Mrs Robert Hutchinson and daughter Frances, Samuel Tucker and Mr and Mrs Harmon Tucker, Mr and Mrs Bruce Barnett and children Charles, Mabel and Blanche and Miss Hazel Kirkendall of Glen Roy.

Ohio Couple Marries After Lengthy Delay
Oregon City, Ore. - Few of the people who forecast marriage for Joseph and Pheobe back in Portsmouth, O.,lived to see the wedding. It took 52 years for this couple to tie the knot. The couple, now Mr. and Mrs. Joseph D. Mault, originally planned to be married in 1894 at Portsmouth. But they broke up and the intended bride married Joseph's uncle. Each lost the original spouse by death, and they finally married each other in Salt Lake City, according to children in Oregon City. Both are 72.
Childhood Sweethearts, 72, Reunited, Married
Salt Lake City - Childhood sweethearts, reunited after a separation of a quarter century, were married Thursday by John A. Harter, Salt Lake county license clerk.
The newly-weds are Joseph D. Mault, 72, of Salt Lake City, and Mrs. Phoebe Matilda Mault, also 72, of Hood River, Oreg.
Mault said the two had drifted apart after a youthful romance, and each had married--Mrs. Mault to a cousin of the new bridegroom. They lost contact for "some 20 to 30 years"' he continued, but recently he learned that Mres. Mault was living in Hood River and invited her to Salt Lake City.
She responded and the marriage followed. Both had been widowed after their earlier marriages.

"My mother's father's name was James Pewtherer or Pewterer. He was born in Scotland. Do not know date of his birth or death. He died in Ohio, Hamden, I think.
"Mothers's mother's name was Elizabeth Kuykendall or Kirkendall. Born in Penn. near Philadelphia. Do not know date of her birth or death, or of their marriage. Her mother was from Holland, I think. (This means my great great grandmother)....
"My mother's name--Elizabeth Pewtherers. Born April 9, 1825, in Ohio, near Hamden, Vinton County.
"They were married Dec. 31, 1845. It think they were married near Hamden Ohio also....
***************************
"I also remember that my mother told me many times about her great grandfather who was a member of the Scotch House of Commons and whose name was John Calendar. That must have been her father's maternal grandfather.
"Mother also used to tell us that through her Scotch father she was related to the House of Mary, Queen of Scots, but I do not know in what way. Her mother was married twice; the first time to a man named Price--she had one son by that marriage, named Jacob. Grandfather Pewthers also was married twice and had two sons by his first marriage, James and John.";
My analysis:
"My mother's father's name was James (She must have meant John, because later she mentions that he married Widow Price and there is a marriage record for John Pewters and Betsy Price in Scioto county. Also, her sister Nancy names him John in the letters that follow.) Pewtherer or Pewterer. He was born in Scotland. Do not know date of his birth (abt 1774) or death. He died in Ohio, Hamden, I think.
"Mother's mother's name was Elizabeth Kuykendall or Kirkendall. Born in Penn. near Philadelphia . Do not know date of her birth (abt 1781) or death, or of their marriage (10 Sep 1812, Scioto county, Ohio). Her mother was from Holland, I think. (This means my great great grandmother) (actually only her great grandmother)....
"My mother's name--Elizabeth Pewtherers. Born April 9, 1825, in Ohio, near Hamden, Vinton County. (No Vinton county until 1850.)
"They were married Dec. 31, 1845. (County record of license is actually 24 Dec 1846. Though the actual marriage may have been performed on the 31st, the year is off.) It think they were married near Hamden Ohio also.... (License issued in Jackson county. Vinton county not created until 1850.)
***************************
"I also remember that my mother told me many times about her great grandfather who was a member of the Scotch House of Commons and whose name was John Calendar. That must have been her father's maternal grandfather. (There is a record of one James Pewterer being christened 16 Sep 1781 in Bo'Ness, West Lothian, Scotland. Parents, James Pewterer and Elizabeth Calendar. This baby is likely John's younger brother, who eventually settled in Perry county, Ohio.)
"Mother also used to tell us that through her Scotch father she was related to the House of Mary, Queen of Scots, but I do not know in what way. Her mother was married twice; the first time to a man named Price (there is a marriage record for John Pewters to Betsy Price 10 Sep 1812 in Scioto, Ohio)--she had one son by that marriage, named Jacob. Grandfather Pewthers also was married twice and had two sons by his first marriage, James and John."
